Trade Secret

Trade secrets are IP rights on confidential information which may be sold or licensed. In general, to qualify for trade secret:

  • commercially valuable because it is secret

  • be known only to a limited group or persons 

  • be subject to reasonable steps taken by the rightful holder of the information to keep it secret

Trade secrets encompasses technical information (manufacturing processes, pharmaceutical test data, and designs of computer programs) and commercial information (distribution methods, list of suppliers and clients, and advertising strategies)

Trade secrets are different from the other three sectors because intentional theft has to be proved. Since they are secrets, they have no chance to be exposed to the public. This defeats the defense of "prior art", allowing someone to acquire the information independently.  There is no formal application to apply for a trade secret. 

This is another sector, where it is best to consult an attorney when legal action is necessary.
